Welcome to FanTokTics. These Terms of Service govern your access to and use of FanTokTics, a product developed by FanTokTics Inc.
By accessing or using FanTokTics, you agree to be bound by these Terms, as well as our Privacy Policy. If you do not agree with any part of these Terms, you must not use our service.
You must be at least 13 years old to use FanTokTics. If you are under the age of majority in your jurisdiction, you may only use the platform with the permission of a parent or legal guardian. By creating an account, you represent that all information you provide is accurate, complete, and that you will keep it updated. You are responsible for maintaining the confidentiality of your login credentials and for any activity that occurs under your account.
FanTokTics allows users to connect their YouTube accounts via OAuth 2.0 and provides an AI-powered platform that generates short-form videos using the most engaging moments from their YouTube content. The service may include automatic clip detection, trending audio pairing, text overlays, post scheduling, and other tools intended to simplify social media promotion for creators.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable license to use FanTokTics for personal or business promotion purposes. You may not copy, modify, distribute, sell, or lease any part of our platform or software, nor may you reverse-engineer or attempt to extract the source code unless laws prohibit these restrictions.
By uploading content to our platform or connecting external media (e.g., YouTube videos), you grant us a worldwide, non-exclusive, royalty-free license to host, store, display, and process your content solely for the purposes of providing and improving the services. You retain all ownership rights to your original content. You are solely responsible for ensuring you have all necessary rights and permissions to use and share any content through our platform.
You agree not to misuse the FanTokTics service. This includes but is not limited to: using the platform for illegal activities, posting or distributing harmful or infringing content, attempting to gain unauthorized access to our systems, or interfering with the normal operation of the service. We reserve the right to investigate and take legal action for any violation of this clause.
Some features of FanTokTics may require payment. By subscribing to a paid plan, you agree to pay all applicable fees as described at the time of your purchase. All fees are non-refundable unless otherwise stated. We reserve the right to change pricing or features of subscription plans with prior notice. You are responsible for managing your subscription, including cancellation, through your account settings or the billing provider used.
Our service may integrate with third-party platforms (e.g., YouTube, TikTok). By using these integrations, you agree to comply with their respective terms of service and privacy policies. We are not responsible for any third-party platforms or services, and any data you share with them is subject to their practices.
We collect and process your personal data in accordance with our Privacy Policy, which explains how we handle your information. This includes data related to your connected YouTube channel, generated content, usage activity, and any optional demographic or engagement metrics you provide. We use encryption, role-based access, and secure cloud services to protect your information.
FanTokTics, its branding, codebase, interface, and underlying technologies are the intellectual property of FanTokTics Inc. and are protected under applicable copyright, trademark, and other intellectual property laws. You may not use our trademarks or branding elements without our express written consent.
We reserve the right to suspend or terminate your access to FanTokTics at our sole discretion, without notice, if we believe you have violated these Terms, misused the platform, or acted in a way that could harm our reputation or infrastructure. You may also choose to terminate your account at any time via your settings or by contacting our support team.
FanTokTics is provided "as is" and "as available." We do not guarantee that the service will be error-free or uninterrupted, or that any content generated will meet specific marketing goals or social engagement metrics. You use the service at your own risk. We disclaim all warranties, express or implied, including any warranties of merchantability, fitness for a particular purpose, or non-infringement.
To the maximum extent permitted by law, FanTokTics Inc. and its affiliates, directors, officers, employees, or agents will not be liable for any indirect, incidental, special, or consequential damages arising from your use of, or inability to use, FanTokTics. Our total liability in any matter related to the service is limited to the amount you have paid to us in the last 12 months, if any.
You agree to indemnify and hold harmless FanTokTics Inc. and its affiliates from any claims, losses, damages, liabilities, costs, or expenses (including legal fees) arising out of your content, your use of the service, your violation of these Terms, or your infringement of any rights of another party.
We reserve the right to modify these Terms at any time. If changes are made, we will notify you via email or within the platform. Continued use of FanTokTics after any modifications means you accept the updated Terms. You should review the Terms regularly.
These Terms shall be governed by the laws of the State of Florida, United States, without regard to conflict of law principles. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Sarasota County, Florida.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and FanTokTics Inc. with respect to the use of FanTokTics. If any part of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue to be in full force and effect.
